Terms and Conditions of Sale and Installation – Discount Granite AZ
1. Binding Nature of Orders All purchase orders for goods and services placed with Discount Granite AZ are considered binding and final. No order may be cancelled, altered, or amended without the explicit written permission and consent of Discount Granite AZ.
2. Cancellation Policy and Fees Should Discount Granite AZ agree to an order cancellation, the Client will be subject to a restocking and cancellation fee of up to 25% of the total item sales price. This fee will be subtracted directly from any deposits or funds previously paid at the time of sale.
3. Schedule of Delivery and Installation Any dates provided for delivery or installation are strictly estimates and are not guaranteed. If the Client is unable or refuses to accept delivery or installation when the materials are ready, the Client assumes full responsibility for any resulting storage costs and/or rescheduling fees.
4. Liability for Damage Discount Granite AZ assumes no liability for defects or damages resulting from the Client’s negligence, improper use, or lack of care regarding the installed goods.
5. Disclaimer of Warranties Except as expressly stated within this agreement, Discount Granite AZ disclaims all warranties, whether express or implied. This includes, but is not limited to, implied warranties of merchantability and fitness for a specific purpose.
6. Limitation of Damages Discount Granite AZ shall not be held liable for any compensatory, exemplary, or consequential damages occurring due to delays in performance or any other factors related to the sale and installation process.
7. Natural Product Variations The Client acknowledges that natural stone products are unique and may exhibit variations in texture, color, and dimensions. Discount Granite AZ is not liable for damages or dissatisfaction arising from these natural characteristics or necessary modifications made during the installation process.
8. Scope of Services and Extra Costs Requests for services beyond the standard installation—such as additional grinding, polishing, or sanding of granite and marble surfaces—will incur additional charges to be paid by the Client.
9. Recovery of Collection Costs In the event that the Client breaches this agreement, Discount Granite AZ reserves the right to recover all expenses related to the collection of debts, including reasonable attorney fees and legal costs.
10. Jurisdiction and Venue Any legal proceedings or litigation resulting from this agreement shall be held exclusively in Maricopa County, Arizona, and shall be governed by the laws applicable to Discount Granite AZ’s jurisdiction.
11. Interpretation of Agreement Both parties acknowledge their role in the formation of this Agreement. Therefore, any ambiguous terms within this document shall not be legally interpreted or resolved against any specific party.
12. Entirety of Agreement This document serves as the complete and exclusive understanding between the parties, superseding all prior agreements or discussions. No changes to this Agreement are valid unless they are documented in writing and signed by both parties.
